<span>My husband is experiencing the same problem and we are currently waiting since September for an appeal date.
Accident occured in 1998 and my husband was a welder and suffered whiplash and shoulder and lower back injury when rearended in the parking lot leaving work. Received NEL and 28% disability to neck and shoulder. Comp will not accept claim to lower back as my husband had previous claim. Went through joke of retraining to be a security guard. Doctors initial letter of restrictions stated no sitting for longer that one hour, no standing for longer than one hour, no overhead work and no constant neck flexion. These restrictions are valid but not accepted. He also now suffers from cluster migraines and can really not do anything repetitive or for long periods. When these headaches strike, he is totally disabled. Life sucks but we try to keep spirits up and keep going as our daughters are only 12 and 8 and we don't want them to experience our panic. We both know that he cannot work 40 hours as a security guard. He can not drive for long periods to commute to work and a security guard either sits and watches or walks and watches. I refuse to become a widow when he tries to drive home on the 401 with one of his migraines (always brought on by driving long without being able to lay flat and hard.) We did unfortunately hire one of these SUPPORT COMPANIES and VocServ has done absolutely nothing for us. They are one of these companies that only use voicemail and don't return phone call. This company was asked to file an appeal with wsib concerning the retraining. My husband is asking to have the 40 work week lowered to part time and the restriction of security guard removed from the job description so that he has the ability to make money doing something that will not further destroy him and us. We discovered in the end of August that the paperwork was never sent in. When asked why, this company replied that they were very busy. They do have our retaining fee and have received their large percentage from my husband's NEL, of which they did not have to fight anything. They then told my husband that they had nothing else to fight for him. CAN WE FIRE THEM WITH OUT THEM BEING ABLE TO CHARGE US THEIR $300.00 PER HOUR FEE FOR BREAKING CONTRACT. This company is supposed to be our representation at the appeals process and since September my husband has never heard from his caseworker nor have they ever met in person. Sorry, I got a bit carried away here. Perhaps if all injured workers band together and share information, more members can beat the crooked system. Thanks for letting me ramble. Dear Friends Many of us has wsib prolems.I have seen people refer wsib advocates in this forum. Injured workers institute wants big money from you.For example 600 bucks up front and If I am not mistaken 25% of what they get from WSIB.That is 25% of your pain POOF! I am not just poinying them out but many advocates are not shy to take big money from you.Ask before you sign up please. sparky RE: wsib/ employers

Listen to people that tell you to contact the group of lawyers and ex WSIB workers in Hamilton,Ontario call "THE INSTITUTE FOR INJURED WORKERS" They chrge $700.00 for a retainer and $25% of your LARGE settlement since you can't work due to a work place injury.Let me be clear when I say you are being lied to and screwed over by WSIB.They don't want to pay you the money your supposed to get see site called "CANADIAN COUNCIL FOR INJURED WORKERS" it's 14 pages long to print but you will educated yourself on WSIB rules and how they act in "BAD FAITH" !!! along with a U of T survey about WSIB etc. Re: Injured worker trying to find employment before WSIB cuts off my benefits

Pauline, I to am an injured worker. I am suffering from reprocussions of Carpal Tunnel Syndrome. After 4 surgeries 24hr/day pain, morphine to help with it, by the way it only helps a tiny bit. Any way, WSIB screwed me so many times I can't count how many on my fingers now. My story was: got hurt on the job, went for "training" as a AutoCAD Architectural Designer. But the school I was sent to well. . . was foney! After 10 months of complaining to my caseworker at WSIB and a disabilities agency, they managed to basicly wreck my life and family's life. After fighting with them for 1 year, I finally got some relief. They sent me to Fanshawe College for a new career change. I am now going to classes for a Social Service Worker. With this career, I do not have to use my hands as often as I did as a welder. I am 42 years old, and in this area of careers the market is screeming for older workers with plenty of life skills, and experience in the real world. Go For it girl!! Try to fight their descissons, if you can get a lawyer, good luck, none would even touch my case because of an internal conspiracy with 3 WSIB workers and the disability worker (he used to work for WSIB), ya knows all the ropes alright, knows how to rip the injured worker off. Personally, I think that the workers at WSIB should have an attitude investigation, 'cause plenty of them have an ATTITUDE. There is something wrong in this country if an injured worker cannot receive compensation for giving their lives for our jobs. But then, our veterans never receive adiquit compensation for what they have sacrificed either. Any way, fight, fight, fight with all your might. Hey, Many of the people who have put something on this discussion board have the thought the same as you are thinking. But in reality, if you do something hurtfull to yourself, WSIB wins and you lose big time. Think of all the others that love you and really care for you, if you pull the plug on yourself you pull it on them to. Think twice or more if need be. I to at times thought it would be better the other way but it isn't. Don't give up, things do get better. It takes plenty of very small steps to get across this bridge of agony. Over my hand problems from an injury, I am now 27% disabled, didn't get **** from WSIB, sorry yes I did get **** from WSIB, just ****!! But I faught to get a chance at a new career as a Social Service worker, and maybe with a little luck, some day I might be the one that has the say about what will happen to one of the pricks at WSIB or the disability place that has been a festering boil on my ass for the past 12 years. Accident: October27, 1980 I was on a job site bending over to pick up my leather work gloves off the ground, Moments after coffee break 2:20 PM suddenly a passing gravel truck (Mack) collided with the 580 Case backhoe I was crouching beside! Causing it to tumble in my direction with increased velocity @30Mph + The boom of the machine was swinging towards me fast! It struck me incredibly HARD, in the left side of my left knee! Shattering and exposing various bones while slamming me to the unpaved ground landing on my right elbow. A second later the backhoe stopped moving and was upside down still idling and leaking fuel oil profusely onto the ground. The weight of the backhoe was crushing my leg! I was underneath the boom pinned to the ground. I was there for almost � hour! Do to the large amount of blood loss I was feeling cold and weak but still conscious and in pain�It was grossly horrific and my leg was almost severed at the knee @work�I was released from the hospital 3 weeks later I had lost 80 pounds received a bone graft , skin graft , blood transfusion and left with post traumatic stress disorder. 6 weeks later and still waiting for a relief cheque as I had lost my ability to work construction. I struggled to get to the wcb because I was an injured worker and needed compensation. "I met the mean lady" the wcb receptionist Laura Ozwald. She labeled my claim on day one. She wrote a letter stating I swung a crutch at here and then says I called her a @#$%& whore... Nobody else seen or heard anything the panic button was not pressed ....I don't remember saying anything even close to that, I do remember my leg was bleeding and Sore. I never saw her shoddy letter for six years. That�s probably why the people @wcb where rude and un-caring . I consider her letter to be false and fraudulent and just another example on how far wcb will go to pinch pennies on a six dollar an hour claim and it took her 10 days to write her label letter.I am a accuseing her of false and fraudulent statements but it appears that�s what they are paid for and they do it daily.They keep telling me to forget about it and her letter is still on top of my claim file 25 years later. Make a note I have also seen Laura Ozwald threaten another injured worker with one of her fraudulent label letters. They are a barrier and have as much rehabilitative value as she does and that is none. I was not physically fit to swing cructh at anyone it�s just a nother wcb penny pinching tactic ,they new I was pension claim before I showed up that day they needed something so they could screw another injured worker out of benefits right from the beginning�."So maybe she got a fat bonus" A couple extra Big Macs per week NEXT: 12 weeks later the wcb made me sign a waver giving up my right to recover damages from the third party...They were to recover damages in my behalf. With in a year a received a letter from a corrupt wcb lawyer. The letter had no address or phone number on it? It stated it would be very difficult to recover damages in this claim...It was difficult even to get bare minimum web rates. I had asked where the letter came from and they said rudely said just forget about it .I was hurt October 27,1980 and did not find work until the spring of 1983 with no help from wcb just insults and misleading advice. The average of my wcb benefits paid while I was injured was less than $6per day. If I had seen Laura Ozwalds fraudulent letter I would have never elected the wcb shoddy crappy service. They would had to find someone else to insult and play their stupid appeals game. I truly regret ever going to the wcb...The corruption goes on and on for the next 25 years.. 13 weeks later Next: I meet Ralph Singer My Claims Adjudicator Now the only thing in my claim file is Laura Ozwalds fraudulent letter of corruption. My claims adjudicator when we met asked what I did before my accident? I told him I had played hockey. He then told me the wcb had a hockey team and are playing Thursday night at North Rink...I took a taxi to north rink that night on crutches with multiple fractures in my leg and large open wound and not to forget about the nine pins and wire in my knee...I looked around he was not their and wcb did not even have a team...This is the epitome of the unsportsmanlike like conduct that injured workers are exposed to... My wcb compensation rate was $666 per month, Laura Oswald laughed and thought it was funny! I had complained enough that wcb compensated me every 2 weeks at $333 My-wcb Question? How can they justify there fat pay checks and lush pensions when their service is so shoddy? Did you know WSIB president David Williams makes $752,000 per year and has never seen an injured worker.
